  1. If you are the victim of a DUI-related car accident, how much time may pass between your car accident and opening a legal case? You have a two-year statute of limitations, during which you can bring suit.
  2. Do you have to submit to DUI testing? When you get behind the wheel, you give implied consent for alcohol and drug testing. You can refuse, but risk harsher penalties.
  3. What are the different categories of Driving Under the Influence (DUI)? Based on the results of your DUI test, you fall into one of the three categories below - which determine the severity of your sentence.
    1. General Impairment: .08-.10
    2. .10-.16
    3. .16 and above
  4. If you have a Commercial Driver's License (CDL), can you be randomly drug tested - even if there is no reason for your employer to do so? Yes, it doesn't matter if you are exhibiting any unusual signs - your employer can test you whether or not they have reason to believe you are violating company policy.
  5. What if you are pulled over for a DUI, but are just sleepy? The officer will most likely pull you over for erratic driving, but will not charge you with an offense.
  6. What happens if drugs are found in your system after you are pulled over? If you test positive for drugs during a DUI stop, you will be automatically bumped up to the highest degree of intoxication on the three-tier scale - .16 and above. This level carries the harshest penalties.
