While common law marriage is no longer valid in the state of Pennsylvania, under former laws, to enter into a common law marriage, two persons needed to hold a ceremony, whether public or private as long as it was witnessed by others, agree to be married and hold themselves out to the public as married.

Fast Fact: The Pennsylvania Legislature abolished common law marriage in the state of Pennsylvania in 2005. This law does not affect common law marriages entered into before the law went into effect.

In Pennsylvania, married persons that have filed for divorce, but have not yet finalized the divorce may be entitled to temporary spousal support (alimony) based on the parties financial circumstances. This temporary support is legally referred to as alimony pendente lite. While temporary support may be awarded until the divorce is finalized, the temporary support award does not mean that an award of permanent support is justified. A family law judge will look at other factors when determining whether a party to a divorce is entitled to a permanent spousal support award.
