Strict Product Liability Laws - Toyota, Graco Strollers and Dangerous Cribs

Pennsylvania is one of many states with strict product liability laws. This means that, in the case of a dangerous product that has been shown to cause injury, the manufacturer is held liable. Strict liability, in product liability cases, focuses on the product itself.

This means that legal focus is applied to the product itself, rather than the manufacturer. Even if the product was manufactured correctly - if it has a defective design, the manufacturer will still be held liable. Plaintiffs need only show that the product in question caused harm.

Recent posts in the MyPhillyLawyer blog have highlighted the dangers of certain products, including the sudden acceleration in Toyota vehicles and the Graco baby stroller recall.

Fast Facts Related to this Week's Court Radio Show

  • Strict liability means that the manufacturer is held responsible, even if the product was manufactured correctly.
  • All an injured party has to do is show that they were harmed by the product due to some defect or failure in proper use warning.
  • There are three different types of product liability:
    1. Design defects (manufactured fine, designed wrong)
    2. Manufacturing defect (designed fine, manufactured wrong)
    3. Warnings failure (warnings for proper use are not given, or adequately displayed)
