In a difficult case involving right-of-way on a thoroughfare, our client, a man in his 70s, stopped at a stop sign, saw that the road was clear, and made a left-hand turn headed southbound. At the same time, the defendant driver approached in a southbound left-hand turn lane and the two vehicles collided head-on. Our client was taken to the hospital by ambulance and received treatment for soft-tissue injuries. Our client later reported frequent severe headaches, insomnia and other injuries associated with the accident.
We sued the defendant driver, who claimed no liability because she had the right-of-way in the southbound left-hand turn lane. After a $22,000 award for our client in arbitration, the defendant appealed and we tried the case. The jury found the defendant liable and awarded our client $75,000.
At trial, we obtained a verdict for our client that was three times the amount awarded in arbitration.
