{"id":4608,"date":"2017-03-17T04:31:55","date_gmt":"2017-03-17T09:31:55","guid":{"rendered":"https:\/\/www.myphillylawyer.com\/?p=4608"},"modified":"2017-03-17T07:30:41","modified_gmt":"2017-03-17T12:30:41","slug":"13-4m-in-damages-awarded-in-med-mal-heart-surgery-case","status":"publish","type":"post","link":"https:\/\/www.myphillylawyer.com\/yue\/2017\/03\/17\/13-4m-in-damages-awarded-in-med-mal-heart-surgery-case\/","title":{"rendered":"$13.4M in Damages Awarded in Med Mal Heart Surgery Case"},"content":{"rendered":"<p><span style=\"font-weight: 400;\">A Georgia man who suffered catastrophic injuries during heart surgery in 2010 in a South Dakota hospital has been awarded $13.4 million in damages by a federal court judge.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">The plaintiff, Hudson Myers, was 21 years old when he underwent &#8220;controversial&#8221; <\/span><a href=\"http:\/\/www.argusleader.com\/story\/news\/2017\/03\/03\/medical-malpractice-judgment-might-largest-state-history\/98695690\/\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">heart valve replacement surgery<\/span><\/a><span style=\"font-weight: 400;\"> on Oct. 14, 2010 at Rapid City Regional Hospital, according to a March 3 story by <\/span><i><span style=\"font-weight: 400;\">The (Sioux Falls, S.D.) Argus Leader<\/span><\/i><span style=\"font-weight: 400;\">. <\/span><\/p>\n<p><span style=\"font-weight: 400;\">During the procedure, air bubbles made their way into Myers&#8217; arteries and into his brain, causing severe brain damage, the story reported. The surgery was performed by Dr. James Oury, who was in 2014 reprimanded by the South Dakota Board of Medical and Osteopathic Examiners for &#8220;failing to disclose medical malpractice lawsuits and criminal charges&#8221; when he applied to practice medicine in the state, the report continued. \u00a0\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Myers&#8217; lawsuit contended that Oury &#8220;was not competent to perform the procedure&#8221; and that the hospital &#8220;had a duty to provide competent surgeons,&#8221; the story reported.
