{"id":7485,"date":"2019-04-05T10:03:16","date_gmt":"2019-04-05T15:03:16","guid":{"rendered":"https:\/\/www.myphillylawyer.com\/?p=7485"},"modified":"2019-04-05T17:56:57","modified_gmt":"2019-04-05T22:56:57","slug":"personal-injury-attorney-wins-24-8-million-verdict-for-roofer-who-suffered-catastrophic-injuries-when-he-tripped-and-fell-through-a-roof-skylight-at-auto-body-shop-while-making-roof-repairs","status":"publish","type":"post","link":"https:\/\/www.myphillylawyer.com\/yue\/2019\/04\/05\/personal-injury-attorney-wins-24-8-million-verdict-for-roofer-who-suffered-catastrophic-injuries-when-he-tripped-and-fell-through-a-roof-skylight-at-auto-body-shop-while-making-roof-repairs\/","title":{"rendered":"Personal Injury Attorney Wins $24.8 Million Verdict for Roofer Who Suffered Catastrophic Injuries When He Tripped and Fell Through a Roof Skylight at Auto Body Shop While Making Roof Repairs"},"content":{"rendered":"<p>A suburban Philadelphia roofer who tripped and fell\nthrough a roof skylight while making roof repairs at an auto body shop in Delaware\nCounty in June of 2016 has been awarded $24.8 million jury verdict after <a href=\"https:\/\/www.law.com\/thelegalintelligencer\/2019\/03\/28\/roofer-seriously-injured-in-skylight-fall-awarded-25m\/\" target=\"_blank\" rel=\"noopener\">suffering\ncatastrophic brain injuries<\/a>, multiple bone fractures and partial blindness\nin the accident.<\/p>\n\n\n\n<p>The victim, Sean Kalinowski, and his wife, Michele,\nreceived the jury award following a month-long trial in the Philadelphia Court\nof Common Pleas after filing a personal injury lawsuit, according to a March 28\nstory by <em>Law.com<\/em>. <\/p>\n\n\n\n<p>Sean Kalinowski, who was in his early 40s at the time of the incident, was\nworking on the roof of an auto body shop in Aston when he likely tripped on a\npallet on the roof or on the skylight mounts and fell through the glass skylight\nto the concrete floor about 20 feet below, the story reported. <\/p>\n\n\n\n<p>The lawsuit for the Kalinowski family argued that guard rails or screens\nshould have been installed around the skylight to protect anyone on the roof\nfrom falls, the report continued. The building housing the auto body shop is\nowned by 2626 Market LLC and was being leased by ABRA Auto Body &amp; Glass.\nBoth companies were named as parties in the lawsuit.<\/p>\n\n\n\n<p>A pretrial memo from the plaintiff&#8217;s attorneys argued that the defendants\nwere&nbsp;negligent for failing to provide a safe workplace or to warn Kalinowski\nabout the dangerous condition on the roof, the story states. The memo also\nargued that another skylight on the roof had recently been damaged by a heavy hood\ncover and while repairs were being made to it both defendants had been told\nthat the skylights were dangerous and could result in an injury.<\/p>\n\n\n\n<p>Kalinowski suffered a severe traumatic brain injury and multiple fractures\nfrom the fall he sustained and underwent numerous intensive care treatments,\nincluding craniotomies, tracheostomy and plate fixation, the story reported.\nAfter two months of hospitalization, he was treated at a nursing facility for a\nmonth and then spent three months at Bryn Mawr Rehabilitation Hospital.
