{"id":7619,"date":"2019-07-12T11:39:59","date_gmt":"2019-07-12T16:39:59","guid":{"rendered":"https:\/\/www.myphillylawyer.com\/?p=7619"},"modified":"2019-07-12T11:40:08","modified_gmt":"2019-07-12T16:40:08","slug":"car-accident-attorney-wins-8-97m-for-crash-involving-dominos-pizza-driver","status":"publish","type":"post","link":"https:\/\/www.myphillylawyer.com\/yue\/2019\/07\/12\/car-accident-attorney-wins-8-97m-for-crash-involving-dominos-pizza-driver\/","title":{"rendered":"Car Accident Attorney Wins $8.97M for Crash Involving Domino&#8217;s Pizza Driver"},"content":{"rendered":"<p class=\"wp-block-paragraph\">A Florida jury has awarded $8.97 million in damages to\nthe widow of a former fire chief who became a quadriplegic after he swerved his\ncar and crashed on a Florida highway to avoid a collision with a car being\ndriven into his lane by a <a href=\"https:\/\/blog.cvn.com\/breaking-8.97m-verdict-against-dominos-pizza-over-crash-that-ultimately-killed-former-fire-chief\" target=\"_blank\" rel=\"noopener\">Domino&#8217;s\npizza delivery driver<\/a>. <\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The victim, Richard Wiederhold, was 62 years old and had\nretired as a fire chief in Brevard County, Florida, when the crash occurred in\nMarch of 2011 on Florida State Road 50, according to a June 14 report by <em>CVN.com<\/em>.\nWiederhold was driving in his truck along the road when he allegedly swerved\nsharply to avoid a collision with a pizza delivery car being driven by Jeffrey\nKidd, the story reported. Wiederhold&#8217;s truck drove into the median and then\nback across the roadway before overturning following the near-collision.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Wiederhold\nwas left a quadriplegic due to his injuries and was unable to care for himself\nafter the crash. He later <a href=\"https:\/\/www.orlandosentinel.com\/news\/breaking-news\/os-dominos-pizza-lawsuit-richard--wiederhold-20160411-story.html\" target=\"_blank\" rel=\"noopener\">died\nabout 15 months after the incident<\/a> due to complications from his injuries,\nthe report stated.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Kidd,\nthe driver of the Domino&#8217;s delivery vehicle, was found by a jury in Florida&#8217;s\nNinth Judicial Circuit court to be 100% responsible for the crash that led to\nWiederhold&#8217;s injuries. &#8220;Jurors concluded Kidd, and the Fischler\nEnterprises Domino\u2019s franchise he worked for at the time of the crash, were\nagents of the larger Domino\u2019s Pizza corporate franchisor, rendering the pizza\ngiant, the case\u2019s named defendant, liable,&#8221; the story reported. <\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Domino\u2019s\nargued that the franchise Kidd worked for was an independent business and that\nthe corporation was not responsible for his conduct, but the jury disagreed.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The\njury awarded $8 million to Wiederhold&#8217;s widow, Yvonne, and more than $970,000 for\nmedical and other expenses related to his care. Yvonne Wiederhold was a\npassenger in his truck on the day of the crash but the couple had not yet\nmarried. Yvonne Wiederhold said in trial testimony that Kidd caused the wreck\nby pulling dangerously into Wiederhold\u2019s path.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">This\nwas the second trial in the case.
