{"id":7639,"date":"2019-07-19T12:53:43","date_gmt":"2019-07-19T17:53:43","guid":{"rendered":"https:\/\/www.myphillylawyer.com\/?p=7639"},"modified":"2019-07-19T12:53:52","modified_gmt":"2019-07-19T17:53:52","slug":"car-accident-lawyer-reaches-1-53m-settlement-for-family-of-motorcyclist-killed-in-crash-with-skid-steer-loader","status":"publish","type":"post","link":"https:\/\/www.myphillylawyer.com\/yue\/2019\/07\/19\/car-accident-lawyer-reaches-1-53m-settlement-for-family-of-motorcyclist-killed-in-crash-with-skid-steer-loader\/","title":{"rendered":"Car Accident Lawyer Reaches $1.53M Settlement for Family Of Motorcyclist Killed in Crash With Skid-Steer Loader"},"content":{"rendered":"<p class=\"wp-block-paragraph\">The family of a 55-year-old Pennsylvania motorcyclist who\nwas killed in 2016 when his motorcycle struck a skid-steer loader that was being\nused to clean up a street has reached a $1.53 million settlement in the case.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">William Moon Jr. was riding his motorcycle east on Bredinsburg Road in Oil City in\nwestern Pennsylvania on Oct. 4, 2016, when he crashed into the skid-steer\nloader that had apparently <a href=\"https:\/\/www.law.com\/thelegalintelligencer\/2019\/07\/11\/estate-defendants-failure-to-use-traffic-controls-led-to-motorcyclists-death\/\" target=\"_blank\" rel=\"noopener\">created\na cloud of dust<\/a> as it was being used to clean up a buildup of mud on the road,\naccording to a July 11 story on <em>Law.com<\/em>. Moon suffered fatal injuries\ndue to the collision and his fall from the motorcycle.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In a lawsuit filed by Moon&#8217;s widow,\nthe family sued Michael Brown, who was operating the skid-steer loader and Brown\u2019s\nemployer, Clint Brown &amp; Sons Inc., the story reported. Also sued by the\nfamily was Seneca Resources Corp., which owned an adjacent property that Brown\nwas cleaning at the time of the crash, and the company that hired &nbsp;Brown&#8217;s company to perform the cleaning,\nCatalyst Energy Inc.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The wrongful death lawsuit alleged\nthat Brown was negligent in operating the skid-steer loader and that the\nremaining defendants were vicariously liable for Brown\u2019s actions.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The plaintiffs alleged that Brown\nlacked the experience to perform the work he was doing and that the cloud of\ndust he was raising as he performed the work completely blocked Moon\u2019s view of\nthe skid-steer loader on the roadway. The lawsuit also alleged that Catalyst\nviolated safety regulations by sending Brown to operate a large piece of\nmachinery with a road sweeper to clean a buildup of mud on Bredinsburg Road and\nthat the company failed to bring in flag people and warning signs to let\ndrivers know of the dangers at the work site.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">An expert engineer for the\nplaintiffs argued that those shortcomings were the proximate cause of the\naccident and that had the safety steps been provided the crash would likely not\nhave happened.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">After the crash he was flown by\nmedical helicopter to a hospital where he was pronounced dead &#8220;He was\ndiagnosed with significant blunt force trauma to his head, neck and trunk; a\nlaceration of his lower frontal scalp; depressed and comminuted fractures of\nthe frontal bone of his skull, with extension to the orbital bones and anterior\nbase of the skull; lacerations and contusions of the frontal lobes of his\nbrain; fractures of the T2 vertebra and pelvis; and multi-compartmental\nintracranial hemorrhages of his brain, including subdural, subarachnoid,\nintra-parenchymal and intraventricular hemorrhages,&#8221; according to the\nstory. The victim is survived by his wife, two children and two grandchildren.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The case was scheduled in the Allegheny\nCounty Court of Common Pleas.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Under the settlement, Seneca\nResources, which was self-insured, agreed to pay $30,000.
