{"id":7669,"date":"2019-08-16T10:00:13","date_gmt":"2019-08-16T15:00:13","guid":{"rendered":"https:\/\/www.myphillylawyer.com\/?p=7669"},"modified":"2019-08-15T20:26:48","modified_gmt":"2019-08-16T01:26:48","slug":"med-mal-lawyer-wins-2-4m-verdict-for-man-in-delayed-cancer-diagnosis-case","status":"publish","type":"post","link":"https:\/\/www.myphillylawyer.com\/yue\/2019\/08\/16\/med-mal-lawyer-wins-2-4m-verdict-for-man-in-delayed-cancer-diagnosis-case\/","title":{"rendered":"Med Mal Lawyer Wins $2.4M Verdict for Man in Delayed Cancer Diagnosis Case"},"content":{"rendered":"<p>After going to see a doctor for an undisclosed medical\ncondition in December of 2010, a former New Jersey man did not seek additional\ntreatment because his doctor didn&#8217;t communicate that any further medical\ninvestigation should be sought.<\/p>\n\n\n\n<p>But just a little more than three years later, the\npatient, Mark Heiser, was <a href=\"https:\/\/www.law.com\/njlawjournal\/2019\/07\/12\/sanitation-worker-recovers-4-35-million-in-ocean-county-for-loss-of-leg\/\" target=\"_blank\" rel=\"noopener\">diagnosed\nin February 2014 with stage IV kidney cancer<\/a> that had spread to his\npancreas and required the removal of his left kidney, a portion of his\npancreas, his adrenal glands and spleen, according to a July 12 story on <em>Law.com<\/em>.<\/p>\n\n\n\n<p>Now\nHeiser has won a $2.4 million jury verdict in Camden County Superior Court\nafter alleging that his doctor, Toby Soble and Family Practice Associates of\nVoorhees, &#8220;failed to properly communicate and follow up&#8221; in\nconnection to Heiser&#8217;s care after his initial Dec. 20, 2010 medical appointment\nrevealed an &#8220;incidental finding on a lumbar MRI.&#8221;<\/p>\n\n\n\n<p>Heiser, who lived in\nCherry Hill, N.J., at the time of his visit to Heiser&#8217;s office, alleged in a medical\nmalpractice lawsuit filed against Heiser and the practice that his February\n2014 cancer diagnosis resulted because Soble and the practice provided inadequate\nfollow-up care following the MRI back in 2010.<\/p>\n\n\n\n<p>About seven months\nafter Heiser&#8217;s initial cancer diagnosis in February 2014, the cancer was found\nto have metastasized to his lungs. Heiser, who is now 70 years old, was\ndiagnosed with leptomeningeal disease requiring craniospinal radiation. <\/p>\n\n\n\n<p>Heiser has been\nconfined to an electric mobility scooter and a wheelchair since his cancer\ndiagnosis and has lost his independence, according to his lawyers. Heiser formerly\nworked as a pediatric anesthesiologist at Children\u2019s Hospital of Philadelphia.\nHe now lives near Clearwater, Florida, near his daughters.<\/p>\n\n\n\n<p>After hearing\ntestimony in the case, the jury ordered Soble to pay a $2.4 million judgement\nto Heiser, including $500,000 for past pain and suffering, $1.5 million for\nfuture pain and suffering, $375,000 for future lost income and $31,064 for\nmedical expenses, the story reported.
