{"id":7728,"date":"2019-10-04T12:36:55","date_gmt":"2019-10-04T17:36:55","guid":{"rendered":"https:\/\/www.myphillylawyer.com\/?p=7728"},"modified":"2025-06-03T18:22:22","modified_gmt":"2025-06-03T23:22:22","slug":"car-crash-attorney-reaches-400000-settlement-for-couple-seriously-injured-in-collision-at-a-dangerous-intersection-in-new-york-state","status":"publish","type":"post","link":"https:\/\/www.myphillylawyer.com\/yue\/2019\/10\/04\/car-crash-attorney-reaches-400000-settlement-for-couple-seriously-injured-in-collision-at-a-dangerous-intersection-in-new-york-state\/","title":{"rendered":"Car Crash Attorney Reaches $400,000 Settlement for Couple Seriously Injured in Collision at a Dangerous Intersection in New York State"},"content":{"rendered":"<p class=\"wp-block-paragraph\">A New York State couple\nwho were badly hurt in 2014 in a two-car crash at an intersection that was\nknown for being dangerous have received a $400,000 settlement in connection\nwith the case.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Donna Wells of Gouverneur, N.Y., was driving a\n2011 Nissan Murano SUV west on County Route 14 in St. Lawrence County when\nthe vehicle was struck at 4:30 p.m. on March 29, 2014, by a 2014 Dodge\nminivan &nbsp;being driven by Matthew D. Bell\nof Waddington, N.Y., according to a Sept. 10 story by <em>NNY360<\/em>. <\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Mrs. Wells, who was 62 at the time of the\ncrash, was driving in the Murano with her husband, James in the front passenger\nseat. Bell, who was 23 at the time of the crash, was driving south on County\nRoute 31 when his vehicle struck the Wells&#8217; SUV. The couple&#8217;s lawsuit alleged\nthat Bell had failed to yield at the stop sign, causing the crash.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The couple&#8217;s lawsuit alleged that the county &#8220;failed\nto have proper signage warning drivers of the unusual angle of the intersection\nand also failed to remove trees and shrubs that obstructed the sight line\napproaching the intersection.&#8221;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The suit also alleged that St. Lawrence County&#8217;s\ngovernment &#8220;was aware of numerous accidents at the intersection and failed\nto install a four-way traffic signal.&#8221;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The collision left Mrs. Wells with serious injuries\nthat have left her permanently disabled, the lawsuit continued. She suffered a fractured\nhumerus that has dramatically reduced the use of her left arm from the shoulder\ndown, as well as an infection which came following the long-term use of\nantibiotics, the suit alleged. Mrs. Wells also suffered a left brachial plexus\ninjury, a right tibial plateau fracture, a non-displaced sternal fracture, a glenoid\nfracture, a displaced superior scapular fracture, blood loss, anemia and atrial\nfibrillation following the crash. She underwent multiple surgeries and had\nextended stays in hospitals and rehabilitation facilities, the story continued.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Mr. Wells suffered fractured ribs, low back\npain and leg pain due to the crash, according to the story.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The intersection, which had been the subject\nof 10 written and oral complaints from the public and town officials for two\nyears prior to the accident, had two signs at the time of the crash advising\ndrivers that they were approaching a stop sign. Those original signs have since\nbeen replaced with larger stop signs at the intersection, increasing the size\nfrom 3 to 4 feet.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">&#8220;Despite concerns raised about the\nintersection, engineering studies weren\u2019t conducted by the county that could\nhave led to improved safety measures,&#8221; the couple&#8217;s lawsuit alleged.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The county legislators voted 12-3 to pay $300,000 from the county\u2019s\nself-insured liability and casualty reserve account toward the settlement to\nthe Wells family, with the other $100,000 coming from Bell&#8217;s insurance company.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Legal cases like this one occur around the\nnation every day and are examples of similar kinds of truck and car crash cases\nthat&nbsp;<em>MyPhillyLawyer<\/em>&nbsp;attorneys regularly work on tirelessly for\nour own clients.
