{"id":7796,"date":"2019-11-15T13:03:25","date_gmt":"2019-11-15T18:03:25","guid":{"rendered":"https:\/\/www.myphillylawyer.com\/?p=7796"},"modified":"2019-11-15T13:04:23","modified_gmt":"2019-11-15T18:04:23","slug":"personal-injury-lawyer-wins-1-5m-for-badly-injured-train-crash-victim","status":"publish","type":"post","link":"https:\/\/www.myphillylawyer.com\/yue\/2019\/11\/15\/personal-injury-lawyer-wins-1-5m-for-badly-injured-train-crash-victim\/","title":{"rendered":"Personal Injury Lawyer Wins $1.5M for Badly Injured Train Crash Victim"},"content":{"rendered":"<p class=\"wp-block-paragraph\">After being seriously injured as a passenger in a New Jersey\nTransit commuter train crash in 2016, a 45-year-old New York woman will now receive\na $1.5 million settlement to compensate her for her injuries. <\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The settlement for plaintiff LaTonya Story, of\nGarnersville, N.Y., came more than three years after the Sept. 29, 2016 crash,\nwhich occurred as a commuter train was <a href=\"https:\/\/www.nj.com\/traffic\/2019\/11\/woman-injured-in-hoboken-train-crash-gets-15m-from-nj-transit.html\" target=\"_blank\" rel=\"noopener\">pulling\ninto Hoboken Station<\/a> in New Jersey, according to a Nov. 12 story by <em>NJ.com<\/em>.\nThe train, which was being operated by Metro North west of the Hudson River\nunder contract with NJ Transit, failed to stop as it arrived in the station and\nplowed through a concrete bumper at the end of the tracks, injuring 108 people\nand killing a woman inside the station after she was struck by falling debris,\nthe story reported. The train station suffered $6 million in property damage\ndue to the crash.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Story was sitting in the last car of a Hoboken-bound\nPascack Valley train number 1614 when the crash occurred, causing back, neck,\nshoulder and hip injuries, according to her lawsuit, which was filed against NJ\nTransit and Metro North by her personal injury lawyer. Treatments for her\ninjuries has been complicated by an existing auto-immune\nsystem disorder and had left her unable to work due to chronic pain, according\nto her attorney. The lingering injuries will require extensive medical care and\nmonitoring for the rest of her life. The victim was heading to her job as an\nexecutive assistant on the day of the crash.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In\nJanuary, the&nbsp;<a href=\"https:\/\/www.nj.com\/politics\/2018\/02\/safety_board_blames_hoboken_crash_on.html\" target=\"_blank\" rel=\"noreferrer noopener\">National Transportation Safety\nBoard ruled<\/a>&nbsp;that the crash was caused by undiagnosed sleep apnea\nwhich affected the train&#8217;s engineer, Thomas Gallagher, the story reported. The\ntrain sped up to 21 mph, twice the posted speed limit, when it crashed.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Gallagher\nwas found unconscious in the cab of the train after the crash and&nbsp;told investigators he had no recollection of\nthe crash.\nThe engineer was fired by NJ Transit, but was reinstated in September after a\nsuccessful appeal, as long as he meets medical and other conditions.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Metro\nNorth officials confirmed it will cover the cost of the settlement because\nStory boarded the train in New York state.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Legal cases like this one occur around the nation every day and\nare examples of similar kinds of truck and car crash cases that&nbsp;<em>MyPhillyLawyer<\/em>&nbsp;attorneys\nregularly work on tirelessly for our own clients.
