{"id":7858,"date":"2019-12-30T11:40:35","date_gmt":"2019-12-30T16:40:35","guid":{"rendered":"https:\/\/www.myphillylawyer.com\/?p=7858"},"modified":"2019-12-30T12:05:05","modified_gmt":"2019-12-30T17:05:05","slug":"happy-new-year-2020-from-myphillylawyer-and-our-new-years-reminder-to-drive-safe-and-sober","status":"publish","type":"post","link":"https:\/\/www.myphillylawyer.com\/yue\/2019\/12\/30\/happy-new-year-2020-from-myphillylawyer-and-our-new-years-reminder-to-drive-safe-and-sober\/","title":{"rendered":"Happy New Year 2020 From MyPhillyLawyer, and Our New Year&#8217;s Reminder to Drive Safe and Sober"},"content":{"rendered":"<p class=\"wp-block-paragraph\">With the recent Hanukkah, Christmas and Kwanzaa\nholidays behind us and New Year&#8217;s Eve coming up this week, car crash attorneys <em>MyPhillyLawyer<\/em>\nwant to remind everyone about the &nbsp;dangers of&nbsp;drunk driving and DUI as we begin\nto welcome the approaching New Year of 2020.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">To fight to keep drunk drivers off our roads this holiday\nseason the Pennsylvania State Police will once again be participating in the\nNational Highway Traffic Safety Administration\u2019s (NHTSA) \u201c<a href=\"https:\/\/www.nhtsa.gov\/es\/drunk-driving\/drive-sober-or-get-pulled-over-holidays\" target=\"_blank\" rel=\"noopener\">Drive\nSober or Get Pulled Over<\/a>\u201d impaired driving enforcement campaign through Jan.\n1, 2020, joining more than 10,000 other law enforcement agencies across the\ncountry that are working to cut DUI deaths and injuries over the holidays, when\nthe dangers are more prevalent. <\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Pennsylvania State Troopers will conduct dedicated DUI\npatrols and checkpoints to identify and arrest impaired drivers, while a team\nof certified drug recognition experts \u2014 troopers who have received specialized\ntraining to distinguish the physiological signs of impairment caused by a wide\nrange of controlled substances \u2014 will be on the lookout for drivers who are\nimpaired by drugs as well. Drivers who are operating vehicles while under the\ninfluence of drugs will also be targeted and arrested.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">During the New Year\u2019s and Christmas holidays in 2018,\nthere were 285 drunk-driving-related fatalities across the nation, according to\nthe NHTSA. For all of 2018, there were 10,511 people killed nationwide in&nbsp;<a href=\"https:\/\/www.nhtsa.gov\/risky-driving\/drunk-driving\" target=\"_blank\" rel=\"noopener\">drunk driving crashes<\/a>,\naccounting for nearly one-third of the yearly driving fatalities. <\/p>\n\n\n\n<p class=\"wp-block-paragraph\">A DUI conviction in Pennsylvania can include thousands\nof dollars in fines, mandatory license suspension and prison time.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">To prevent that, the NHTSA created the&nbsp;<a href=\"http:\/\/www.pa.gov\/apps\" target=\"_blank\" rel=\"noopener\">SaferRide smartphone app<\/a>, which can be\ndownloaded to a smartphone for free to quickly pinpoint the user\u2019s location and\ncall a taxi or trusted friend for a ride home. The app is available for Android\nand Apple devices.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">We all are responsible, starting with each of us\nindividually, to choose not to consume alcoholic beverages and then hop into\nour vehicles and drive when our driving skills are impaired.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Bartenders, waiters, waitresses and restaurant and\nclub owners are also responsible through liquor liability laws and dram shop\nliability to&nbsp;ensure that none of their customers drinks so much that they\nare visibly intoxicated and a danger to others on the roads.&nbsp; In\nPennsylvania, and in other states, there are training programs for bartenders\nand wait staffs so that they learn when and how to stop customers who are\ndrinking too much.&nbsp; The Pennsylvania Liquor Control&nbsp;Board (LCB) offers\nits&nbsp;&nbsp;<a href=\"http:\/\/www.lcb.pa.gov\/Education\/RAMP\/Pages\/RAMP-Certification.aspx\" target=\"_blank\" rel=\"noopener\">Responsible\nAlcohol&nbsp;Management Program&nbsp;(RAMP)<\/a>, which offers a full range of\nimportant training.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">That\u2019s a good thing, but it doesn\u2019t end there.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">If you are hosting a holiday party this New Year&#8217;s Eve,\nyou should be aware of the potential legal liabilities&nbsp;that exist when\nenjoying the season and serving alcoholic beverages to friends, family and\ncolleagues.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In Pennsylvania, party hosts by law are not held liable\nand can&#8217;t be sued for damages if they serve a visibly intoxicated person and\nthat person subsequently injures himself or someone else while driving drunk,\nunder the Commonwealth&#8217;s laws. This also extends to companies which serve\nalcohol to employees at company holiday parties \u2013 the companies are not\nresponsible if someone is hurt or killed due to the actions of a visibly\nintoxicated employee or guest who attended the party.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The exception to this in Pennsylvania is if a host\nserves any amount of alcohol to an underage person. In this case, the social\nhost has absolute liability in any damage or injury claims.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In New Jersey, however, and other states, this legal\nconcept of social host liability is the law of the land and you can be sued by\nvictims if someone at your party drinks to excess and harms someone else in a\nDUI crash or related incident. Under the New Jersey law, party hosts can be\nsued and found liable for damages if they continue to serve alcohol to a\nvisibly intoxicated person.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">But while Pennsylvania doesn\u2019t include social host\nliability in its statutes, we all still need to be aware of the issues of\nholiday drinking and work to ensure our guests head home safely. We all must be\nstewards of this responsibility.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">You must be able to say no to your friends and loved\nones if they party too much. If someone is visibly intoxicated, don\u2019t let them\ndrive away on their own.&nbsp;Get them in a taxicab or find them a ride with\nsomeone who has not been drinking. Let them sleep in your spare room. Do\nwhatever it takes to prevent a tragedy.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Remember, don\u2019t drink and drive \u2013 it can be a life or\ndeath choice. Don\u2019t become one of the statistics or hurt or kill someone else\nor someone you love by driving drunk and getting into a serious accident.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Think of it this way \u2014 if your teen-aged son or daughter is out driving this New Year&#8217;s Eve, would you rather not allow drunk drivers to be out there on the streets with them, sharing the roads and plowing into them? That\u2019s one reason why we all have to be vigilant for each other.\u00a0 It doesn\u2019t always happen to other families.\u00a0 Such tragedies have perhaps happened to someone in your family, or a friend\u2019s family.
