$100K Settlement for Child Hurt in N.J. Car Crash
By Dean I. Weitzman, Esq. on September 4th, 2015
The family of a 4-year-old New Jersey boy who was hurt in a 2014 car crash will receive a $100,000 settlement in compensation for the boy’s injuries.
The child, Liam DiLeo, suffered a serious head wound when another car collided with the vehicle being driven by the boy’s mother on May 6, 2014 in Parsippany, N.J., according to an Aug. 14 story in The (Parsippany, N.J.) Daily Record.
The boy’s mother, Lilly DiLeo of Hopatcong, N.J., was driving a Toyota Corolla east on Route 80 when Xi Lin, 22, the driver of a Porsche Cayenne, missed his exit, struck a concrete barrier and collided with the DiLeo’s Toyota, the story reported. The crash occurred in a construction zone.
The boy was 3 years old at the time of the crash and was sitting in a rear car seat in his mother’s Toyota, the story reported. He suffered a severe gash across his forehead that exposed more than 30 percent of his scalp and required 250 stiches to close, the report continued. The boy did not suffer any cognitive or other injuries from the crash, the story said.
The boy’s parents, Lilly and William DiLeo, filed a lawsuit on their son’s behalf seeking compensation for his pain and suffering. A settlement was reached with each driver’s insurance company paying $50,000 toward the claim, according to the story, even though Ms. DiLeo was not at fault in the crash. A New Jersey Superior Court judge has approved the settlement.
The DiLeo’s have also filed a separately lawsuit against the driver of the other vehicle, the report said.
