$3.4M Verdict to Woman Hurt by Rolling Out-of-Control Tow Truck

A Nevada woman who was seriously injured when the car she was driving in 2013 was struck by an out-of-control, flatbed tow truck that rolled down a hill, causing a chain-reaction crash into her car, has been awarded a $3.4 million verdict by a Nevada jury.

The victim, Zuhey Cobos, now 41, suffered serious back, neck and shoulder injuries in the crash when the flatbed tow truck’s parking brake failed, according to a June 1 story by Courtroom View Network. When the parking brake failed, it allowed the truck to roll away from a gas station where it had been parked and crash into another vehicle, which was pushed into the rear of Cobos’ car, the story reported.

The tow truck, a 1998 Navistar 4000-series flatbed model, was parked at the gas station while its driver was inside the gas station, according to a product liability lawsuit filed by the plaintiff. The suit “accused Navistar International Corp. of failing to act on multiple reports of at least six similar brake failures that preceded the accident,” according to the story.

The truck, which was owned by Tri-State Towing, was being operated by driver James Rubicco. The towing company argued that the crash was caused by a defective parking brake on the Navistar truck, which suffered a broken bolt that led to the incident, the story reported.

The truck had rolled backward down an incline onto a busy street when the crash occurred.

Navistar was found to be 75 percent responsible for the accident by the state jury, while the tow truck company was held liable for 25 percent of the liability.
