$2.1 Million Settlement Reached By Philadelphia Car Accident Attorney for Man Who Suffered Traumatic Brain Injury When Thrown from a Car in Crash with Truck

A 65-year-old Georgia man who was thrown from a car in a crash on I-95 in Bensalem in September 2016 has reached a $2.1 million settlement with the trucking company whose driver caused the crash.
Nagesh Roy was a passenger in the car when it was struck and pushed into a guardrail by a truck that was merging into the left lane, according to a Nov. 21 story from The Legal Intelligencer. The car, which was being driven by Pramod Patel, then spun and was struck by another vehicle.
The truck was owned by trucking company Freymiller, Inc., and was being operated by driver Jackie Barnett, the story reported.
Roy, who had been working as a FedEx manager, was ejected from the vehicle during the crash and suffered a wide range of serious injuries, including a traumatic brain injury, a skull fracture, hematoma, a subarachnoid hemorrhage, a brain contusion, a rib fracture, a wrist fracture and a shoulder fracture. The injuries have resulted in cognitive losses and issues for Roy since the crash, according to the story.
In his lawsuit, Roy and his wife, Daksha Roy, who was also a passenger in Patel’s car on the day of the crash, alleged that the truck driver “had been speeding, smoking a cigarette, driving with one hand and had not properly checked the mirrors or used the turn signal before moving into the left lane” at the time of the crash.
The couple’s lawsuit, which was filed in the Philadelphia Court of Common Pleas, was settled for $2.1 million from Freymiller and for an additional $15,000 from the insurance company for the other driver involved in the crash, for a total of $2,115,000.
