Car Accident Lawyer Wins $33 Million Jury Verdict for Family of Man Killed When His Car Was Struck By a Cement Mixer That Had a Blown Goodyear Tire

The surviving family of a 58-year-old man who was killed in 2013 by a cement truck that smashed into the victim’s car on a Texas highway has been awarded a $33 million jury verdict in connection with the man’s death. 

The victim, Ramiro Munoz Jr., died on June 11, 2013, when his car was struck by a cement mixer that had experienced a blown Goodyear tire, according to a Feb. 26 story by the Corpus Christi Caller-Times.

Munoz, who was the city manager for Carrizo Springs, Texas, was driving in his pickup truck on U.S. Highway 83 north of the city when a left front Goodyear tire failed on a nearby cement mixer, causing the vehicle to roll over and slide down the road into Munoz’s truck.

His family sued the maker of the cement truck’s tire, the Goodyear Tire & Rubber Co., alleging the tire was faulty and caused the fatal crash. Also named in the lawsuit was DGJ Transport Inc., the operators of the cement mixer.

The plaintiffs alleged that an investigation of the cement mixer found that the blown tire was defective and had suffered a catastrophic tread separation, which led to the crash, the story reported.

Court records identified the tire involved in the crash as a Goodyear G286A Super Single heavy truck tire, which was made by Goodyear in 2009 at its plant in Dansville, Virginia, according to the story.

The jury, which found Goodyear to be 90 percent responsible for Munoz’s death in the crash, determined that a manufacturing defect in the tire was a “producing cause of the death in question,” the story reported from court records.
