Car Accident Lawyer Reaches $2M Settlement for Driver Who Suffered Brain and Spinal Injuries in Crash With Another Car As He Tried to Avoid a Double-Parked UPS Delivery Truck

With a doubled-parked UPS delivery truck blocking his lane, a New Jersey motorist was seriously injured in August 2011 as he steered his own car around the UPS truck, causing him to collide head-on with another car.
The victim, Paul Cuff, will now receive a $2 million settlement for his injuries, which included brain and spinal issues, according to a recent story by Law.com.
Cuff was driving on Mount Prospect Avenue in Newark, N.J., on Aug. 17, 2011, when the incident occurred as he crossed the center line of the roadway and cross into oncoming traffic, the story reported.
The UPS truck was double-parked while its driver was making a delivery.
After being hurt in the crash, Cuff was unable to return to his job as a boiler system engineer due to his injuries, including short- and long-term memory loss and a herniation at L5-S1, which required back surgery and ongoing pain management treatment, the report continues.
During the case, both sides disagreed over the plaintiff’s discovery requests about prior crashes involving double-parker UPS delivery trucks and about UPS policies about leaving delivery trucks double-parked in the street, the story reported. UPS did not collect data about crashes involving double-parked vehicles, but plaintiff counsel alleged that the company’s practice of paying tickets for drivers who double-park sent the message that the danger of double-parking is the cost of doing business, the story continued.
