Car Crash Attorney Wins $6.1M for Driver of Car Broadsided by Truck

A 62-year-old California woman who was seriously injured when the car she was driving was violently T-boned by a delivery truck which ran a red light early one morning in 2017 has been awarded a $6.126 million jury verdict in connection with the case.

The victim, Chung Wu Hsu, was driving her 1998 Lexus ES300 eastbound on Newhall Ranch Road at Copper Hill Drive in Los Angeles County on July 5, 2017, when her car was T-boned by a delivery truck owned by R & P Food Processing Inc., according to an Oct. 7 story by The (Santa Clarita Valley) Signal newspaper.

Hsu was proceeding through the intersection on a green light when the box truck, which was  was being driven by Moises Roberto Martinez Diaz, ran a red light and smashed into her car, the story reported. Diaz allegedly dozed off as he drove the truck just before the crash.

The victim suffered serious and permanent injuries in the violent crash, including trauma to her cervical spine, multiple rib fractures and a traumatic brain injury, the report continued.

Diaz allegedly admitted to the investigating officer at the scene that he was “half-asleep” when the incident occurred, the story continued. He was ticketed for running the red light.

The defendants in the case fought liability and Hsu’s claim for damages until the eve of the trial, when the defendants reportedly admitted that the truck driver caused the collision, according to the newspaper.

The jury heard testimony for 15 days and deliberated for two days before delivering a verdict in favor of the victim. Hsu was awarded $275,000 for past economic damages, $851,000 for future economic damages, $1 million in past non-economic damages and $4 million in future non-economic damages to compensate her for her serious and debilitating injuries. And because the defendants rejected an offer from the plaintiffs in December 2017 to settle the case for $1 million, the verdict is subject to prejudgment interest of 10% per year. With the interest, as well as fees and costs, the total result is expected to exceed $7.3 million, according to the story.
